Pursuant to its International humanitarian obligations, every year Canada accepts thousands of refugees who are forced to leave their home country and cannot return home, requiring international protection. Canada offers two different pathways for refugees and asylum seekers: the Refugee and Humanitarian Resettlement Program or the In-Canada Asylum Program.
Refugee and Humanitarian Resettlement Program
You cannot directly apply as a refugee and must be referred by either the United Nations Refugee Agency, a designated referral organization, or a private sponsorship group. There are many different paths to being sponsored depending on your unique situation.
In-Canada Asylum/Refugee Protection Program
You may also seek refugee protection if you are already in Canada or have a visa to travel to Canada and can meet certain requirements.
At Kaminker & Associates, we have helped refugees from around the world successfully come to Canada and resettle. Our team of skilled immigration lawyers offer professional, compassionate, and knowledgeable assistance to refugees and provide personalized advice depending on your unique circumstances.
We will ensure you meet all eligibility requirements, help you navigate the application process, complete all paperwork and documentation, advise you of all necessary supporting evidence that is required to succeed in your case.
If claiming inside of Canada, we work with you to prepare for your hearing with the Immigration and Refugee Board of Canada to ensure you are fully prepared for your hearing day and that your case is fully documented.
If your claim for refugee protection is refused we can assist with an appeal to the Refugee Appeal Division and/or the Federal Court of Canada. In the case of refusal of an overseas resettlement application, our experienced immigration lawyers can assist with reviewing the decision in the Federal Court.
